Your report really doesnt do justice to just how unpleasant those people were. Whether we were right or wrong ( as it happens we were right), there was absolutely no need for the way they behaved. I think at some point every one of us had to ask the poisonous little dwarf to stop swearing at us. I hope she sat at home that night and realised what a tw*t she'd made of hereself.
Shame about the administrative error that led to me riding without an MOT! The secretary will be receiving a severe beating when she comes in this morning!!! Still, sitting in the back of the police car getting told off made me feel like a teenager again - yipee!!!
For those of you watching this thread you will be sorry to hear that we have received confirmation from Northern Area Highways (Devon) that the lane in question is an HMPE (Highway Maintained at Public Expense) and bears the number R7124. Our log number with NA Highways is 9294071.
They were very, very interested in hearing that Kevin and Jean admitted, in fact boasted, that they had taken 2 weekends to block the 'private' road up. It is illegal I believe to block the Queen's Highway and probably illegal to detain people whilst travelling on the Queen's Highway. Dick Turpin used to try it I believe and look where it got him!
I/we have had to make a complaint against Kevin and Jean as the Police won't give me their address without it. The Police ref for this is 209 14/09/09. I'm waiting for them to come and see me!

Excessive VERBAL ABUSE is I believe classed as ASSAULT... a CRIMINAL OFFENCE
.... or perhaps that was just the Met... lot of verbal abuse used against plod in the smoke.. but then K & J would have been detained overnight on suspicion of being illegal aliens, creating crop circles or some other obscure offence!
The severe case of Tourettes from Jean was amazing i dont think even "Eddie Murphy live on stage" could come close to the number of swear words used.
It was funny , sad , twisted, boring , funny, time wasting , fustrating , funny and getting pretty hot with the sun blazing, the police where friendly and thought i might of had a buyer for my kite surf wing in the form of a "Special Constable" who was also in attendance but sadly not !

the legal description is a 'right for all Her Majesty's subjects at all seasons of the year freely and at their will to pass and repass without let or hindrance.

It is a criminal offence to obstruct a public right of way.
Common Law The obstruction of the highway is a public nuisance. A nuisance is something that materially affects the reasonable comfort and convenience of the public when exercising their lawful rights. To commit a public nuisance is a crime at common law.
Highways Act 1980 Section 137 of this Act makes it a criminal offence for any person, without lawful authority or excuse, wilfully to obstruct the free passage along a highway. A person found guilty of an offence under this section of the Act is liable to a heavy fine. A highway means a way over which the public have a right to pass and repass. The nature of the rights depends on the category of right of way: footpath, bridleway, byway or restricted byway.
Countryside and Rights of Way Act 2000 Under amendments made by this Act, a court has the power to order anyone convicted of an offence under Section 137 to remove the offending obstruction. Failure to comply with such an order is a second offence punishable by a fine of up to £5000. If the obstruction is not removed following conviction for the second offence, a third offence is committed, punishable by a fine of up to £250 for each day the obstruction remains in place

I think the murk in Mikes past is so thick that all incriminating details have been permanantly obscured.
Was my own stupid fault, I'm afraid. I was fully aware that I had no MOT and chose to venture out without it. I will pay the 60 quid and think nothing of it. A bit annoying to be caught under those circumstances, cos if it hadnt been for those idiots it would never have happened, but I cant really blame any body else.
Police have been in touch and are very interested in the video so they will be making an appointment on Friday, when the local guy comes off his break, to come and see me and get a statement. They want to interview all of the 6 who were verbally abused and detained in the lane.
