possible new byway


Recieved this from someone with a note on TRF compliment slip to support the order.

May only end up as restricted Byway but nevertheless should be supported.



NOTICE OF ORDER

WILDLIFE AND COUNTRYSIDE ACT 1981
SECTION 53

Cornwall County Council
(Addition of a byway from Byway No-48 to Byway No.49, Perranzabuloe)
Modification Order 2008

Notice is hereby given that the above referenced Order has been submitted to the Secretary of State for determination. An Inspector will be appointed by the Secretary of State to determine the Order.

The start date for the above Order is 09 October 2008.

Consideration of the Order will take the form of a local public inquiry.

The Inquiry will be held at Perranzabuloe Parish Council Offices, Chyanhale, Budnick Estate, Perranporth, Cornwall, TR6 ODB on Tuesday 7 April 2009 at 10.00am.

The effect of the Order, if confirmed without modifications will be to modify the Definitive Map and Statement for the area by adding to them a Byway open to all traffic from Byway No. 48 Perranzabuloe running in a generally westerly direction for a distance of 36.5 metres to Byway No.49 Perranzabuloe in the District of Carrick.

Any person wishing to view the statements of case and other documents relating to this Order may do so by appointment at Cornwall County Council, County Legal Services, New County Hall, Treyew Road, Truro, TR1 3AY between the hours of 9.30 am and 4.00 pm on Mondays to Fridays inclusive.

Timetable for sending in statements of case and proofs of evidence

Within 8 weeks of the start date 04 December 2008

The Order Making Authority must ensure their statement of case is received by the Secretary of State. As soon as possible after receiving it the
Secretary of State will send a copy (excluding copies of any supporting documents) to everyone who has made an objection or representation and the applicant and any other person who has made a representation.

Within 14 weeks of the start date 15 January 2008

Everyone who has made an objection or representation and anyone who wishes to give evidence at the Inquiry must ensure their statement of case is received by the Secretary of State. As soon as possible after receiving them the Secretary of State will send copies to the Authority, the applicant, every other person who has made an objection or representation and any other person who has made a representation (excluding copies of any supporting documents).

Within the same period the applicant (if applicable) must ensure their statement of case is received by the Secretary of State. As soon as possible after receiving it the Secretary of State will send a copy to the Authority, everyone who has made an objection or representation and any other person who has made a representation (excluding copies of any supporting documents).

4 weeks before the date of the inquiry 10 March 2008

The Authority, everyone who has made an objection or representation, the applicant (if applicable) and anyone who wishes to give evidence at the Inquiry must ensure their proof of evidence (together with any summary) is received by the Secretary of State. As soon as possible after receiving them, the Secretary of State will send copies of:

i) the Authority's proof of evidence to everyone who has made an objection or representation, the applicant and anyone who has submitted a statement of case;

ii) the applicant's proof of evidence to the Authority, everyone who has made an objection or representation and anyone else who has submitted a statement of case; and

iii) all other proofs of evidence to the Authority and the applicant.

All parties must keep to the timetable set out above and ensure that statements of case and proofs of evidence are received by the Secretary of State on time. Late documents will be returned.

Don't get too excited about this one folks, I misread the order - looking with my glasses on I see it is a distance of 36.5 and having discussed it with someone who can actually read a map (Roger James - Cornwall Landrover owners club) I see it is a very short piece meant to connect up a bit adjacent to a property

- I haven't seen it on the ground but my best guess is that it is to divert from one side of the property to the other. I would appreciate info from anyone who knows the area.

It doesn't alter the fact that we should support in principle the addition of byway.

I would like to see the original order and details about it before saying why the order is being sought or who by.

(Fixer or Silver Fox please could you remove the attached image from the previous post if possible)
